Description

This precedent document is a template deed of appointment and retirement of a trustee of a discretionary trust. A deed of appointment and retirement establishes the terms and conditions of a new (ie incoming) trustee's appointment following the retirement of a retiring (ie outgoing) trustee, including his or her responsibilities as trustee and the means of potential removal from that position. In effect, the responsibilities of one trustee are assigned to a replacement trustee. The precedent deed of appointment and retirement of a trustee is to be executed as a deed by the retiring trustee, new trustee and appointer.
The precedent includes footnote references to particularly relevant case law and other considerations.
